Wyatt Maxwell, 25, known in Puerto Vallarta as “Louis Whitaker”, 25, was sentenced by U.S. District Judge Roseann A. Ketchmark on Wednesday, Nov. 20, to 20 years in federal prison without parole for child pornography.
The court also ordered Maxwell to pay a $10,000 fine. Maxwell will be required to register as a sex offender upon release from prison and will be subject to federal and state sex offender registration requirements. At the conclusion of his term, he will have another 20 years of supervised release.
Maxwell, who identified as a gay male while living in Puerto Vallarta as a cabaret singer, now identifies as non-binary. pleaded guilty on April 17, 2024, to one count of attempting to produce child pornography. Maxwell lived in Kansas City, Mo., at the time of the offense.
The Overland Park, Kansas, Police Department received tips in February 2021, via the Greater Kansas City Crime Stoppers tipline, that Maxwell was producing child pornography with a 16- year-old victim in Overland Park. Maxwell reportedly uploaded the child pornography to various online accounts. The child victim told investigators that Maxwell had been recording sexually explicit videos of the two of them for several months. Some of the recordings were created at Maxwell’s residence and some were created in a nearby park.
Law enforcement agents interviewed Maxwell on Feb. 3, 2021. Maxwell confirmed they uploaded videos to their accounts on OnlyFans and JustForFans, for which Maxwell estimated they made from $3,000 to $10,000 per month from subscribers. Maxwell admitted they created approximately 20 videos where they were engaged in some type of sex act with the child victim.
Those videos were uploaded to Maxwell’s OnlyFans and JustForFans accounts. Investigators found 39 videos of child pornography that were downloaded on Maxwell’s cell phone, 96 videos of child pornography involving the child victim, and 24 images of child pornography involving the child victim. Investigators confirmed payments from Maxwell’s OnlyFans account totaling $49,151, and from Maxwell’s JustForFans account totaling $2,954. There were 153 videos uploaded to the JustForFans account, 16 of which depicted sexual activity involving the child victim.
Maxwell was arrested and extradited from Mexico on a five-count indictment involving child pornography in February 2023. He was indicted by a federal grand jury in Kansas City, Mo., on Feb. 7, 2023. Last seen in Puerto Vallarta on Feb. 14, 2023, he was arrested after one of his shows, loaded into a van by Mexican officials, and deported to Santa Ana, California. While in Puerto Vallarta he did not maintain a low image. He had started a mobile popsicle business, and performed as a cabaret singer in numerous clubs.
“Maxwell will be sent to either FCI Seagoville, TX or Englewood, CO to participate in a sex offender treatment program and continue gender affirming care,” explained Neal Zaslavsky, a California attorney who is a regular visitor to Puerto Vallarta and has been monitoring the case. “
“FGI Seagoville is a minimum security facility about 20 miles SE of downtown Dallas TX. FCI Englewood is a minimum security facility about 15 miles SW of downtown Denver CO. Maxwell is still at FCI Leavenworth, near where the trial is held. It could take the Bureau of Prisons some time before they make the permanent assignment, so Maxwell will remain at Leavenworth until that time.”
Zaslavsky said that federal inmates generally serve 85% of their sentence.
“They (Maxwell) should get credit for time served while awaiting sentencing,” he explained.
They (Maxwell) was requesting 5-10 years of supervised probation and the government was seeking 20 years. I am not surprised the judge went with the 20 year recommendation of supervised release.”
This case was prosecuted by the Assistant U.S. Attorney Alison D. Dunning. It was investigated by the FBI and the Overland Park, Kan., Police Department.
