The Movement for Equality in Mexico, MOVii, reports that on August 27, 2024, the Criminal Court of Control and Orality of the VIII Judicial District, based in Puerto Vallarta, issued a maximum sentence of 40 years in prison against Miguel Ángel N. for the qualified homicide of Michel Rubén Castro Guizar, in addition to ordering full compensation for the damage.
The Unitary Court determined that Miguel Ángel N. is fully responsible for the homicide, based on conclusive evidence such as the body report, autopsy, injury mechanics, photographic sequences, expert reports, circumstantial evidence, blood identification, call history, genetics report, and material evidence of the murder weapon: a hammer with a wooden handle. These elements were considered sufficient and lawful to establish maximum guilt beyond any reasonable doubt.
In addition, Judge Susana Betancourt stressed the relevance of the *disability perspective*, given that Michel Rubén Castro Guizar was a person with a hearing disability. Likewise, the *vulnerability* added by his belonging to the LGBTIQ+ community was taken into account, factors that increased his defenselessness and that were decisive in the severity of the sentence imposed.
The sentence includes *comprehensive reparation of damage*, which includes funeral services and psychological care for indirect victims, among other measures intended to mitigate the impact of the crime.
The hearing for the reading and explanation of the sentence has been scheduled for September 2. MOVii reiterates its commitment to continue accompanying the family of Michel Rubén Castro Guizar throughout the legal process.
