Wyatt Maxell (Louise Whitaker as known in Puerto Vallarta), who was arrested and extradited from Mexico on a five-count indictment involving child pornography in February 2023, will have a pretrial conference on Jan. 31, 2024.
The Pretrial Conference for Wyatt Christopher Maxwell is set for 1/31/2024 at 11:50 a.m. in Courtroom 7E, Kansas City (JAM) before Magistrate Judge Jill A. Morris.
A pre-trial conference is a court hearing where a prosecutor and a defense attorney get together and discuss whether a case is going to go to trial or whether it can be resolved through a plea agreement.
OAPV reported in Sept. 2023 that defense counsel, Chelsea Wilson, said the parties had discussed the possibility of resolving this case without the need for a trial but have not yet reached a resolution. Unless a plea bargain is reached, the trial is set to begin on Feb. 12, 2024.
Maxwell (Whitaker) has pled “not guilty” and maintained he is innocent and that he was mislead while making pornography
“However, in early 2021, I discovered that one of the individuals I collaborated with had been deceitful about their age, misleading numerous people both online and in person. This revelation sparked an investigation into the knowledge and intentions of those who had worked alongside this individual, and during that time, I wholeheartedly cooperated with the FBl, providing them with all the information I possessed. I willingly handed over the requested content and promptly removed it from my social media platforms. Furthermore, I willingly submitted to a polygraph test, and all parties involved were interviewed to shed light on the situation. The content creator in question eventually confessed to the police, admitting that they had deceived not only me but others as well. At that moment, I believed that justice had been served and that the matter was resolved by the authorities,” he wrote in a message on his instagram account in June 2023. He had someone post the note anonymously.
He has been in federal prison for almost a full year. Whitaker was last seen in Puerto Vallarta on Feb. 14, 2023. He was arrested after one of his shows, loaded into a van by Mexican officials, and deported to Santa Anna, CA. He was then ordered to be held without bond and transferred to a federal prison, Leavenworth.
“My heart sank when reality dealt me a cruel blow. It was on February 14th, 2023, that the US indicted me on federal charges and apprehended me in Puerto Vallarta. Two agonizing nights were spent in a Mexican detention center before I was transported to the Western District of Missouri to face a federal judge,” he said on the Instagram post. “Hope of release was shattered when bail was denied, and I found myself confined in pre-trial custody within the walls of Leavenworth United States Penitentiary, a storied institution among federal prisons. To compound the hardships, my home in Vallarta was violated, and everything I owned, including my hard-earned savings, was mercilessly stolen. In this dire situation, I was assigned a compassionate Federal Public Defender named Chelsea Wilson, who tirelessly fights for justice alongside her legal team.”
The five count indictment all involve child pornography, the making or selling and the transportation of a minor for the purposes of making pornography. The federal indictment alleges that Maxwell used a minor victim to produce child pornography between July 31, 2020, and Feb. 1, 2021. The indictment also alleges that Maxwell transported the minor victim across state lines from Kansas to Missouri to engage in illegal sexual activity. Maxwell is also charged with two counts of distributing child pornography over the internet and one count of possessing child pornography. The charges against him include actions between July 31, 2020 and Feb. 1, 2021 that he engaged with a minor to produce porn. Another incident on Dec. 8, 2020, Jan. 24, 2021, Jan. 27, 2021 and Feb. 3, 2021.
